NanoSpotter Terms of Use
These Terms of Use ("Terms") govern your use of NanoSpotter: Ingredient Scan ("NanoSpotter"), provided by FeatureBugg ("FeatureBugg," "we," "us," or "our"). By tapping Agree and continue, you agree to these Terms.
1. What NanoSpotter is
NanoSpotter is an assistive ingredient-awareness tool. It is designed to help you identify, recognize, and understand ingredients you choose to watch for using package-label scanning and, when available, barcode-based product information.
2. Important ingredient and health limitation
NanoSpotter is not a guarantee that an ingredient is present or absent, and it is not a substitute for reading the complete physical package label. Camera conditions, label quality, text recognition, parsing, product databases, manufacturer changes, ambiguous ingredient names, cross-contact statements, and other factors can cause NanoSpotter to miss, misread, or misclassify information.
NanoSpotter does not provide medical diagnosis, treatment, or professional medical advice. If an allergy, sensitivity, medical condition, religious requirement, dietary restriction, or other serious concern is involved, verify the full current package label and contact the manufacturer or an appropriate professional when needed.
3. Physical package information controls
Barcode and database information can be helpful but may be incomplete, outdated, or associated with a different formulation or package. When database information conflicts with the physical product in your hand, you should rely on the current physical package label and manufacturer information rather than NanoSpotter's database result.
4. Profiles, custom concerns, and related terms
You are responsible for the profiles, custom watch terms, messages, and other information you enter into NanoSpotter. A custom concern is not a promise that NanoSpotter knows every alias, derivative, source, spelling, translation, or chemically related ingredient. Related-term information is provided as an aid and may be incomplete.
5. Availability and changes
We may improve, modify, suspend, or discontinue features when reasonably necessary to maintain, secure, or develop NanoSpotter. Network-backed features can be unavailable because of connectivity, third-party services, maintenance, product-record availability, or other conditions beyond FeatureBugg's control.
6. Free access, trials, and paid features
NanoSpotter may provide a limited number of free completed scans and may offer a time-limited trial or paid Pro access. The exact plans, prices, trial eligibility, and benefits shown in NanoSpotter or Google Play at the time of purchase control over older marketing material.
Google Play processes purchases and subscriptions. Auto-renewing subscriptions continue until canceled. Users can manage or cancel eligible subscriptions through Google Play. Cancellation generally stops future renewal while access continues through the applicable paid period, subject to Google Play rules and applicable law. Refund eligibility is governed by Google Play's policies and applicable law unless FeatureBugg expressly offers a different remedy.
A lifetime purchase, when offered, means access to the NanoSpotter Pro entitlement for the commercially supported life of the NanoSpotter service; it does not guarantee that every current feature, third-party service, operating system, or platform will remain available forever.
7. Acceptable use
You may use NanoSpotter for personal or other lawful purposes consistent with these Terms. You may not attempt to abuse scan limits, trials, purchase verification, Play Integrity protections, backend services, or other technical controls; interfere with the service; use automated systems to overload or scrape protected services; reverse engineer protected backend functionality except where applicable law expressly permits it; or use NanoSpotter unlawfully.
8. Third-party services and information
NanoSpotter may rely on third-party services such as Open Food Facts, Google Play, and Supabase. FeatureBugg does not control third-party product data or guarantee the availability, completeness, or accuracy of third-party services. Your use of those services may also be subject to their own terms and privacy practices.
9. Intellectual property
NanoSpotter's software, design, branding, original text, and other FeatureBugg-created materials are owned by FeatureBugg or its licensors and are protected by applicable intellectual-property law. Third-party names, product data, libraries, and other materials remain the property of their respective owners and may be governed by separate licenses.
Subject to these Terms, FeatureBugg grants you a limited, revocable, non-exclusive, non-transferable license to install and use NanoSpotter for its intended purpose.
10. Privacy
Our handling of information is described in the NanoSpotter Privacy Policy. By tapping Agree and continue, you acknowledge the Privacy Policy in addition to agreeing to these Terms.
11. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANOSPOTTER IS PROVIDED "AS IS" AND "AS AVAILABLE." FEATUREBUGG DISCLAIMS WARRANTIES THAT NANOSPOTTER WILL BE ERROR-FREE, UNINTERRUPTED, COMPLETE, OR SUITABLE AS THE SOLE BASIS FOR AN INGREDIENT, ALLERGY, MEDICAL, DIETARY, PURCHASING, OR SAFETY DECISION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEATUREBUGG AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS ARISING FROM RELIANCE ON AN INGREDIENT RESULT, THIRD-PARTY PRODUCT DATA, SERVICE INTERRUPTION, OR UNAUTHORIZED ACCESS, EVEN IF ADVISED THAT SUCH LOSS MAY BE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FEATUREBUGG'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO NANOSPOTTER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FEATUREBUGG THROUGH GOOGLE PLAY FOR NANOSPOTTER DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) US $25. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE LIMITED OR EXCLUDED.
13. Termination
You may stop using NanoSpotter at any time. FeatureBugg may restrict access to network-backed or paid functionality when reasonably necessary to address fraud, abuse, security threats, unlawful conduct, chargebacks, revoked purchases, or material violations of these Terms. Any provisions that by their nature should survive termination will survive.
14. Changes to these Terms
We may update these Terms when NanoSpotter or applicable requirements change. Updated Terms will identify a new version and effective date. When renewed agreement is appropriate, NanoSpotter may require you to review and accept the new Terms. A routine app update does not itself require re-acceptance when the Terms version is unchanged.
15. Governing law
These Terms are governed by the laws of Texas, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise. Nothing in these Terms removes rights you cannot waive under applicable law.
